After non-legal negotiations over a copyright dispute failed, a Colorado non-profit is suing outdoor aparel company Eddie Bauer for violating its trademark. First Descent, which leads outdoor adventures for young cancer sufferers, says that Eddie Bauer’s First Ascent and First Descent lines of clothing have confused consumers trying to identify the non-profit. “[O]ur ability to distinguish our organization and its FIRST DESCENTS® outdoor adventure therapy programs was lost,” First Descent . Eddie Bauer holds copyrights to both First Ascents and First Decents, but says that it . “We are interested in resolving this in a manner that is satisfactory for both parties,” it said.
